ORDINANCE: 2002-28
SUBJECT: An Ordinance declaring the organization of the One Horse Business Improvement District, describing the boundaries and service area of the District, and giving it the corporate name specified in the petition.
RECOMMENDATION: Adoption of the Ordinance.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: A petition for the organization of a Business Improvement District to be located within the City of Lakewood was filed with the City Clerk on July 1, 2002. The Petitioners, Elk Valley Public Improvement Corporation and Colorado Mills Limited Partnership, are the owners of real property in the proposed District.
Once created, the Business Improvement District will be a quasi-municipal corporation and political subdivision of the state of Colorado. The proposed District will be authorized to undertake and provide facilities and services for "Improvements," as more specifically defined pursuant to Section 31-25-1204(5), C. R. S. Pursuant to Section 31-25-1209, C.R.S., the board of directors of the proposed District will be elected by the electors of the District and the board will have those powers that are set forth in an operating plan approved by the City and as set forth in agreements and contracts entered into between the District and the City.
The District is being created to provide certain public improvements and will take the place of the 640 Improvement Corporation in doing so.
The Ordinance contains an emergency provision in order that the District can be established to conduct an election for the District's board of directors who can thereafter assume office and conduct a ballot issue election in the November, 2002, election.
