Ordinance 2002-26 REQUEST FOR COUNCIL ACTION

ORDINANCE: O-2002-26

SUBJECT: Authorizing the approval of quit claim deeds to adjacent property owners for parcels of former right-of-way along the north side of Colfax Avenue between Indiana Avenue and Cole Boulevard.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
Jefferson County originally owned all of the right of way along this part of Colfax Avenue. Many years ago, Jefferson County attempted to convey this right of way to the Colorado Department of Transportation (CDOT), however this conveyance was never properly approved or accepted by CDOT. CDOT later conveyed unneeded portions of this right-of-way back to the adjacent property owners.

Whenever the City of Lakewood annexes county right of way, the ownership of that right of way transfers to the City by state statute. As a result of the events identified above, there is some question whether Lakewood or the adjacent property owners own these parcels. This ordinance will allow the City Manager to execute deeds to quit claim any possible City ownership back to the adjacent owners and is necessary for the adjacent owners to be able to dedicate clear title of portions of these slivers for road improvements in this area in conjunction with the Colorado Mills Development.
