SUBJECT: Regulation of Emissions from Crematories

SUMMARY AND BACKGROUND OF SUBJECT MATTER: Due to problems being created by the excessive smoke emissions from a crematory in Lakewood, the Council has directed that the attached ordinance be brought forward. The ordinance provides for the following:
· Smoke opacity cannot exceed 20% for more than 60 continuous seconds.
· Crematories must install a continuous opacity monitor and recorder.
· All crematories must receive annual service and opacity monitor calibration once a month.
· Records must be provided to the City.
· Operators of crematories must be trained and certified annually.
· Crematories must obtain a license from the City to operate.
· There is an appeal process for license denial.
· The City may suspend, revoke, modify or place conditions on continuation of a license. The licensee is entitled to an appeal hearing.
· Failure to comply with the ordinance is punishable by a fine up to $1,000 per violation and/or jail for up to one year.
