ORDINANCE: O-2002-20
SUBJECT: Ordinance for the establishment of processing fees for License Agreements, Easements and other uses of City Property
ADDRESS: City wide.
RECOMMENDATION: Approve the Ordinance.
FUNDING SOURCE: New fees.
SUMMARY AND BACKGROUND OF SUBJECT MATTER:
As part of the City's ongoing efforts to reduce expenses, increase revenues
and recover expenses wherever possible, the Property Management Division has
identified three specific areas where the costs to process certain requests
for use of City property are not recovered. The fees would be intended to offset
costs to process an application for a private party or other entity to use City-owned
real property for such things as (1) License Agreements, (2) Easements or (3)
other uses of City-owned real property. The purpose of the ordinance is to have
the person or entity that benefits from the specific request to bear the cost
for the City to process and administer the request instead of having the taxpayers
at large pay these costs. These fees would be similar in nature to those charged
by the City for land use and building permit applications. The fees would be
based upon the time typically spent on processing or administering these requests.
The fees would be collected up front, non-refundable and applied regardless
of whether the request is approved or denied. The Ordinance would modify the
Municipal Code to allow these fees to be collected and a separate resolution
would be presented to City Council at the time of the second reading of the
ordinance to set the actual fee amounts once the ordinance becomes effective.
