REQUEST FOR COUNCIL ACTION

ORDINANCE: O-2002-19

SUBJECT: Ordinance authorizing the conveyance of a quit claim deed for 20 feet of property adjacent to Alameda Avenue right-of-way in exchange for a quit claim deed for 30 feet of Alameda Avenue right-of-way.

ADDRESS: Adjacent to 8405 W. Alameda Avenue - North side of Alameda Avenue between Carr Street and Cody Street.

RECOMMENDATION: Approve the Ordinance.

FUNDING SOURCE: Not applicable.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The property owner of 8405 W. Alameda is processing a site plan application to develop the property. The platted lot lies 50 feet north of the section line. The title is clouded for the 50 feet north of the section line and south of the platted lot. The City of Lakewood claims to own the 30 feet immediately north of the section line while the property owner claims to own the entire 50 feet in question.

The City and the property owner have negotiated an agreement by which, the property owner would quit claim the south 30 feet to Lakewood and Lakewood would quit claim the north 20 feet plus small areas for turning radii to the property owner. This would clarify the title for the 50 feet for both parties concerned.
