ORDINANCE: O-2002-14

SUBJECT: Ordinance authorizing the exchange of Quit Claim deeds between the City of Lakewood and the Jefferson County School District - R1 to resolve issues relating to parcel boundaries.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The City of Lakewood acquired Ray Ross Park from Foothills Park and Recreation District in February of 1999 as part of the Joint Exclusion Plan and Agreement for Disposition of Assets and Continuation of Services (Agreement) between the City and the Recreation District.

Subsequent surveys of the property have disclosed that a 10 foot wide gap exists between the park parcel and the property for Deane Elementary to the north. This gap was caused by surveying errors going back to the establishment of the original section and subsequent legal descriptions conveying various parcels in the area.

Exchanging Quit Claim deeds with the School District will eliminate the 10-foot gap, establish a permanent property line between the two parcels and eliminate any discrepancies in ownership between the City and the School District.
