REQUEST FOR COUNCIL ACTION

ORDINANCE: O-2002-11

SUBJECT: Ordinance authorizing the vacation of the South 10 feet of West 11th Avenue adjacent to the properties at 1090 Ingalls Street and 6070 West 11th Avenue, City of Lakewood, County of Jefferson, State of Colorado.

ADDRESS: 1090 Ingalls Street and 6070 West 11th Avenue.

RECOMMENDATION: Adoption of the attached ordinance.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: West 11th Avenue originally had 60 feet of right-of-way as shown, platted and dedicated to Jefferson County by the plat of LAKEWOOD, which was recorded on August 24, 1890, in Plat Book 2 at Pages 14 and 15. The South 30 feet of the right-of-way was then vacated by Jefferson County on December 28, 1906, by Book 153, at Page 220. The property adjacent to this vacated street and the vacated street were re-platted and accepted by the City of Lakewood August 23, 1999, and now known as LAKEWOOD BLOCK 4 FILING NO. 2. The Jefferson County Assessors Office, because they feel that the right-of-way for West 11th Avenue was never vacated, has refused to accept this plat. They are also refusing to work any conveyance deeds that were recorded pertaining to this new plat. The City feels that the right-of-way was vacated by the County which is why the City accepted the plat of LAKEWOOD BLOCK 4 FILING NO. 2. City staff has had a number of discussions with the Assessors Office and have not been able to convince the Assessors Office that this right-of-way was vacated. The Assessors Office, however, has agreed in writing to work the plat if the City would vacate that portion of West 11 Avenue that lies within Lots 1 and 2, of the LAKEWOOD BLOCK 4 FILING NO. 2. City staffs recommendation for the best solution to alleviate this problem is to have City Council approve this Ordinance vacating any interests the City may have in this right-of-way.
