AN ORDINANCE

ORDINANCE AMENDING CHAPTER 1.25 OF THE LAKEWOOD MUNICIPAL CODE RELATING TO THE OFFICE OF ENVIRONMENTAL MANAGEMENT AND AMENDING REFERENCES TO THE ENVIRONMENTAL MANAGER IN SECTIONS 9.30.010, 10.39.120, 13.14.090 AND 14.07.060 OF THE LAKEWOOD MUNICIPAL CODE

WHEREAS, the Office of Environmental Management has been transferred from the Police Department to the Department of Public Works; and,

WHEREAS, certain duties of the Office of Environmental Management have been transferred to the Office of Emergency Management; and,

WHEREAS, it is necessary to amend the appropriate sections of the Lakewood Municipal Code to reflect said changes.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:

Section 1. Chapter 1.25 of the Lakewood Municipal Code is amended to read as follows:

1.25.010 Establishment-Office of Environmental Management.
The Office of Environmental Management, previously established by Ordinance, is continued. Said Office shall be directed by the Environmental Manager of the Department of Public Works.
1.25.020 Appointment of officers and employees.
The Environmental Manager shall be appointed by the Director of Public Works. The Environmental Manager may appoint staff members, salaried and volunteer, as authorized in the City budget. The final appointing authority for all employees within the Office of Environmental Management shall be the City Manager.
1.25.030 Duties of Environmental Manager.
A. The Environmental Manager shall establish the Office of Environmental Management as the coordinating agency for all environmental activities including hazardous material incidents under Article 22 of Title 29 of the Colorado Revised Statutes. The Environmental Manager's duties regarding hazardous materials shall include but not be limited to:

1. Develop and maintain plans and procedures for response and clean up of hazardous material spills within the city;

2. Act as the on-scene commander over all hazardous materials incidents within the city;

3. Coordinate the city's investigation of hazardous material violations;

4. Administer the city's hazardous material identification, transport, and disposal activities;

5. Assist the Police Department in enforcement of federal, state, and local environmental laws; and

6. Conduct environmental audits and environmental assessments of city-owned property.

B. Nothing in this chapter shall be construed to limit the power and authority of the Environmental Manager to enforce other ordinances of the city for which the Environmental Manager has been given enforcement power.

Section 2. Subsection 9.30.010 C of the Lakewood Municipal Code is amended to read as follows:

C. The Environmental Manager shall have the nonexclusive power and authority to enforce the provisions of this section. The Environmental Manager shall be considered a peace officer within the meaning of Section 1.04.010 of this code for purposes of enforcing this section.

Section 3. Section 10.39.120 of the Lakewood Municipal Code is amended to read as follows:

10.39.120 Unattended motor vehicle.
No person driving or in charge of a motor vehicle shall permit it to stand unattended without first stopping the engine, locking the ignition, and removing the key from the ignition. Any person who violates any provision of this section commits a Class 4 traffic offense.

Section 4. Subsection 13.14.090 C of the Lakewood Municipal Code shall be amended to read as follows:

C. The Environmental Manager shall have the nonexclusive power and authority to enforce the provisions of this chapter. The Environmental Manager shall be considered a peace officer within the meaning of Section 1.04.010 of this code for purposes of enforcing the provisions of this chapter.

Section 5. Section 14.07.060 of the Lakewood Municipal Code is hereby amended to read as follows:

14.07.060 Additions to International Fire Code.

The following provisions are added to the end of Article 1, Section 101 of the International Fire Code and are incorporated into the Lakewood Building Code:

101.10 Permit Fees. Fees for permits required by this code shall be as specified in Section 14.02.040 of this Lakewood Building Code.

101.11 The Environmental Manager shall have the nonexclusive power and authority to enforce the provisions of the International Fire Code as adopted in this chapter. The Environmental Manager shall be considered a peace officer within the meaning of Section 1.04.010 of this code solely for purposes of enforcing the provisions of the Uniform Fire Code as adopted in this chapter.

Section 6. This Ordinance shall take effect thirty (30) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 8th day of April, 2002; published in full in the Lakewood Sentinel on the 11th day of April 2002; set for public hearing on the 22nd day of April, 2002; read, finally passed and adopted by the City Council on the 22 day of April, 2002; and signed and approved by the Mayor on the 23 day of April, 2002.
