ORDINANCE: Ordinance O-2002-4
SUBJECT: Vacation Case No. VA-01-006
Vacate the South Reed Street Right of Way, a small portion of the Vance Street
Right of Way and the "South Reed Street" access easement within the
Belmar Redevelopment area. The proposed vacations will help facilitate the redevelopment
of the approximate 105-acre site into a mixed use urban development.
ADDRESS: Two rights-of-way and an access easement located at 7200 West Alameda Avenue, within the Belmar Redevelopment Area.
RECOMMENDATION: Staff recommends approval of this request and adoption of the attached ordinance. Due to the simple nature of this request this case has not been forwarded to the Planning Commission for a review. The overall plan for the Belmar Redevelopment area was reviewed by the Planning Commission at their December 19, 2001 meeting.
SUMMARY AND BACKGROUND OF SUBJECT MATTER:
Rezoning case number RZ-01-006 illustrates the proposed redevelopment of the 105-acre Villa Italia mall area into a mixed used downtown development. That rezoning case was recommended for approval at the December 19, 2001 Planning Commission meeting and is before you concurrently with this vacation request. To better facilitate the redevelopment of the area, an application to vacate two portions of right-of-way and an access easement has been submitted for review and approval. The vacated areas will be utilized for the future development of the site and new rights-of-way will be dedicated in the future. This case was referred to all appropriate utility companies and other referral agencies. Easements will be retained for the utilities within the South Reed Street right-of-way proposed to be vacated until such time as those utilities are abandoned and/or relocated. As part of the proposed Belmar project, a new street grid system is to be constructed and all utilities will be located within the new rights-of-way.
ANALYSIS OF ISSUES:
Title 43, Article 2 of the Colorado Revised Statutes indicates that vacations of right-of-way may only be approved if it is determined that the property is no longer necessary for public use and no land would be left without an established public road. The City has applied this standard to this property and has analyzed the impacts of this vacation upon the surrounding neighborhood, and has determined that no negative impacts would occur.
