ORDINANCE: O-2002-1
SUBJECT: Planned Development Modification Case Number MO-01-002
Modify an existing Virginia Park Official Development Plan for a property within the PD (Planned Development) zone district to allow for the construction of 26 additional multi-family apartment units located at 551 South Ames Street.

RECOMMENDATION: Staff recommends approval of this modification request to allow for the construction of 26 multi-family apartment units. Planning Commission, by a vote of 5-2 at the December 5, 2001 meeting, recommended APPROVAL of this request by City Council.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: The subject property is located at 551 South Ames Street is currently zoned PD (Planned Development). The applicant for the project is requesting to modify the existing Virginia Park Official Development Plan that currently allows for 64 multi-family apartment units to allow for 26 additional multi-family apartment units.
This proposed modification falls under the provisions of Article 17, Section 17-5-22(5)(a) that states if a modification involves a change in 10% or more of the residential density, the modification must be processed as a rezoning case. Therefore, although this case is referred to as a modification of an existing ODP, it is being processed the same as a rezoning case with all of the proper notification requirements.
The Planning Commission recommended approval subject to two conditions. Condition 1: The applicant shall provide to the City an error free photomylar of the Official Development Plan prior to the City Council hearing; and Condition 2: The applicant shall provide to the City the school and park land dedication fees prior to the City Council hearing. These conditions have been met and the case is now ready for City Council review.
