SUBJECT: ZONING ORDINANCE REGULATIONS RELATED TO THE DEFINITION OF SCHOOLS
DECEMBER 2, 2002 STUDY SESSION
On October 7, 2002 City Council conducted a study session at which staff and City Council discussed the Zoning regulations as they relate to "Households" in the City of Lakewood. Included with the Policy Report for that meeting we provided suggestions as to how to deal with the issue of "Schools" allowed in Lakewood. That information is now included in this report.
As discussed in the study session on August 19 with the City Council, "Schools" as currently defined in the Zoning Ordinance allow Colleges/Universities; K-12 schools; and Vocational, Trade or Professional Schools in all Zone Districts throughout the City. Staff suggests that the R1A, RR, 1R and 2R zone districts be amended to not allow Colleges/Universities. Higher Education Classrooms and Offices should be allowed as a Special Use Permit (SUP), which is currently in the Zoning Ordinance. The SUP would be for classroom and office space only in the R1A, RR, 1R and 2R zone districts. Schools, including a College/ University, would be allowed in all other zone districts in the City as a Use by Right.
In addition, staff recommends that the Vocational and Trade School use in the School definition be excerpted out and added as its own definition and that the Vocational & Trade Schools should be allowed in the Office and Commercial zone districts as a Use-by-Right. .
Staff suggests the following definitions and wording to be included in a future Zoning Ordinance amendment to address the issue of schools. Staff expects that more detailed research and revisions to the wording included in this proposal will be necessary before a formal ordinance is written. Staff will continue to work with the City Attorney's Office to ensure the legal issues and interpretation issues are addressed as best as possible.

Proposed Definitions
Dormitories: A multi-unit building included within a College or University campus containing living and sleeping facilities for only students, faculty , or persons participating in College/University activities, and which generally contain a central dining area, central commercial style kitchen, and separate individual sleeping units. A building designed for, constructed as, and used as a single-family dwelling with a single- family household shall not be considered a dormitory.
Higher Education Classrooms and Offices: A place providing higher education beyond grade twelve, which offers either a two year or four year degree in specific disciplines and such Special Use Permit use only includes classrooms and/or offices for the educational institution.
Schools, public, parochial, and private: An institution or place for instruction or education. For purposes of this Ordinance, schools are classified by the type of instruction provided and by student grade level.
a) College/University: A place providing higher education beyond grade twelve, which offers either a two year or four year degree in specific disciplines that may include a combination of the following uses but is not limited to: classrooms, offices, administrative buildings, athletic facilities and fields, dormitories (only for students, faculty or persons participating in College/University activities), scientific laboratories, library, cafeteria, student center, bookstore, and auditorium.
b) K-12 School: A place of learning, whether public or private, which meets state standards for providing instruction for students in kindergarten and grades one through twelve which may include but is not limited to: classrooms, offices, administrative buildings, athletic facilities and fields, cafeteria, bookstore, library, cafeteria, and auditorium.
c) Preschool/Federal Head Start Program: A place of learning, whether public or private, which provides direct education to children to enhance school experiences and opportunities for children in advance of or thru K-12 education.
Vocational, Trade or Professional School: A place of learning providing instruction in specialized skills, such as drafting, computer technology, welding, carpentry, beauty & barber schooling, modeling, or auto repair to prepare students for a specific occupation.

Proposed Article 5 Amendments
Section 17-5-7 (2) (19) R1A: RESIDENTIAL ONE ACRE should be amended to read
as follows:

Section 17-5-8 (2) (15) RR: RURAL RESIDENTIAL DISTRICT should be amended to
read as follows:
Permitted Uses:
· Schools, public, parochial and private, except colleges and universities.
Section 17-5-9 (2) (14) 1-R LARGE LOT RESIDENTIAL DISTRICT should be amended
to read as follows:
Permitted Uses:
· Schools, public, parochial and private, except colleges and universities.
Section 17-5-10 (2) (14) 2-R: ONE FAMILY SMALL LOT RESIDENTIAL DISTRICT should
be amended to read as follows:
Permitted Uses:
· Schools, public, parochial and private, except colleges and universities.
SUMMARY
Staff requests that the future amendment to the Zoning Ordinance includes the revised definitions and allowed uses as outlined above in this report. Staff suggests that the above proposal addresses the issues at hand revolving around where school uses are to be allowed in the City of Lakewood.
Staff will present this information at the joint City Council/Planning Commission Study Session on December 2. We will also strive to answer all questions you may have that evening.
This Policy Report is being reviewed jointly by the City Council and the Planning Commission. If consensus is obtained at the conclusion of the Study Session, staff will prepare the ordinance and submit it to the City Council for consideration and adoption. The Planning Commission will not review the proposed ordinance in a separate public hearing.
