LAKEWOOD LIQUOR AND FERMENTED MALT BEVERAGE
LICENSING AUTHORITY

September 12, 2002

Regular Meeting of the Lakewood Liquor and Fermented Malt Beverage Licensing Authority was held on this date in the City Council Chambers.

ITEM 1. CALL TO ORDER

Chairman Taake called the meeting to order at 7:00 p.m.

Full and timely notice of this meeting had been given and a quorum was present.

ITEM 3. APPROVAL OF MINUTES

Regular Meeting August 8, 2002

Mr. Monsoor moved to approve the minutes of the regular meeting held August 8, 2002. The motion was seconded and with those present voting Aye, THE MOTION TO APPROVE THE MINUTES CARRIED.

ITEM 4. SHOW CAUSE HEARING

Retail Liquor Store License
Extreme Wine & Spirits Emporium, Inc., dba Extreme Wine & Spirits
7986 W. Alameda Ave., Unit A

Deputy City Attorney Kennebeck told the Authority that a complaint was issued against this licensee for the sale of alcohol to a minor that occurred during a compliance check on June 27, 2002. The licensee will stipulate to the violation. Attorney Kennebeck said this is a first offense for this licensee.

Charles Paeplow, P.O. Box 260591, Littleton, CO, President, appeared before the Authority and was sworn in. He stated that he had spoken to the Deputy City Attorney and would stipulate to the violation of selling alcohol to a minor.

Ms. Hansson moved to accept the stipulation between the Deputy City Attorney and Extreme Wine & Spirits Emporium, Inc., dba Extreme Wine & Spirits at 7986 W. Alameda Ave., Unit A. The motion was seconded and with those present voting Aye, THE MOTION TO ACCEPT THE STIPULATION CARRIED.

Mr. Paeplow testified that he fully acknowledges his responsibility as the storeowner and offered his apologies to the Liquor Authority. He has made some changes in store policy and made it mandatory for all employees to attend the City's alcohol training class. He recently attended the training class as well.

Chairman Taake closed the public hearing. Ms. Hansson moved that the following penalty be imposed: a 10-day suspension with five days held in abeyance for one year commencing September 13, 2002. The balance of the suspension is to begin at 8:00 a.m. September 13, 2002, and end at 8:00 a.m. September 18, 2002. The motion was seconded and with those present voting Aye, THE PENALTY MOTION CARRIED.

Mr. Paeplow petitioned the Authority to pay a fine in lieu of the five days suspension.

Mr. Monsoor moved to allow Extreme Wine & Spirits Emporium, Inc., dba Extreme Wine & Spirits to pay a fine in lieu of five days suspension. The motion was seconded and with those present voting Aye, THE MOTION TO ALLOW THE LICENSEE TO PAY A FINE IN LIEU OF SUSPENSION CARRIED.

ITEM 5. NEW APPLICATION

Beer & Wine License
East Buffet Chinese Restaurant, Inc., dba East Buffet Chinese Restaurant
6206 W. Alameda Ave.

Deputy City Attorney Paul Kennebeck told the Authority that he had reviewed the application and had no objections to the issuance of this license.

Su Hsiu Yang, 6969 W. Yale Ave. #74, Denver, CO, President, appeared before the Authority and was sworn in.

Esther Choi, 3950 E. Dartmouth Ave., Denver, CO, Interpreter, appeared before the Authority and was sworn in.

Secretary Laura Bock read an inventory of liquor-licensed establishments into the record. "An inventory of the liquor licensed premises within the neighborhood has been completed. There are three hotel & restaurant licenses, zero brew pubs, five 3.2% fermented malt beverage licenses, two tavern licenses, zero club licenses, three retail liquor store licenses, and no beer and wine licenses located within the boundaries."

Kelly Pietrs, Managing Member of Esquire Petitioning Services, 2792 S. Race St. Denver, CO, appeared before the Authority and was sworn in. She explained to the Authority how her company conducted the survey of the designated neighborhood and then she provided a summary of the results of this particular survey. There were 192 people who signed the petition. Of those signing, 92% were in support of the issuance of a beer and wine license for this location.

In response to questions from the Authority, Ms. Yang stated that she is aware of the City's alcohol training program and after hearing the previous case, she's also aware of the penalties imposed for alcohol violations.

The public hearing was closed and Mr. Wisneski moved to approve the beer and wine license application of East Buffet Chinese Restaurant, Inc., dba East Buffet Chinese Restaurant, 6906 W. Alameda Ave. The motion was seconded and with those present voting Aye, THE MOTION TO APPROVE THE APPLICATION CARRIED.

ITEM 6. GENERAL BUSINESS

(A) DISCUSSION ON UPCOMING ARCADE LICENSE APPLICATION

Deputy City Attorney Paul Kennebeck passed out copies of the arcade ordinance to the Authority members and asked them to review it. Any questions they might have will be addressed at the next Liquor Authority meeting.
He explained to the Authority that they will be acting as the Arcade Licensing Authority to hear testimony on an arcade application that will be applying concurrently with a hotel and restaurant application in October.

(B) WELCOME TO NEW BOARD MEMBER

Chairman Taake welcomed Ms. Stevens to the Authority.

(C) ABSENCE

Mr. Wisneski informed the Authority that he would not be attending the next meeting.

ITEM 6. ADJOURNMENT

There being no further business to come before the Liquor Authority at this time, the meeting adjourned at 7:40 p.m.
