Regular Meeting of the Lakewood Liquor and Fermented Malt Beverage Licensing Authority was held on this date in the City Council Chambers.
ITEM 1. CALL TO ORDER
Chairman Taake called the meeting to order at 7:00 p.m.

Full and timely notice of this meeting had been given and a quorum was present.
ITEM 3. SHOW CAUSE HEARING
Hotel & Restaurant License
Shenanigan's Bar & Grill, L.L.C., dba Shenanigan's Bar & Grill
5240 S. Wadsworth Blvd.
Deputy City Attorney, Paul Kennebeck told the Authority that he had spoken with
Mr. Ed Fleming, managing member of the L.L.C., who had asked if his presence
was required. Attorney Kennebeck informed him that a representative from the
licensee was required to appear. At this time, no one was present to represent
this licensee and
Mr. Kennebeck asked that this matter be moved further down on the agenda in
hopes that someone would show up.
The Authority agreed to hear the pending application and call this matter later.
ITEM 4. NEW APPLICATION
Hotel & Restaurant License
Calo, L.L.C., dba Oliveto Cucina Italiana
3355 S. Yarrow St., Unit E131
Deputy City Attorney Kennebeck told the Authority that he had reviewed the file, all the paperwork is in order, and the City has no objection to the issuance of a license.
Chairman Taake asked the Secretary to read the inventory of liquor-licensed establishments into the record.
Ms. Bock said an inventory of the liquor-licensed establishments within the neighborhood had been completed. There are 12 hotel & restaurant licenses, zero brew pub licenses, one 3.2% fermented malt beverage license, two tavern licenses, no club licenses, one retail liquor store license, and one beer and wine license located within the boundaries.
Jon Stonbraker, registration #9517, appeared on behalf of the licensee.
Bret Mansur, 7589 W. Fremont Ave., Littleton, CO, appeared before the Authority and was sworn in. Mr. Mansur testified that he is the owner of Liquor Petitioning Professionals who conducted the survey for the needs and desires of the neighborhood for this application. He explained how his company conducted the survey and 91% of the neighborhood inhabitants were in favor of this license being granted.
Barbara Calo, 2630 Clear View Dr., Golden, CO, 80401, appeared before the Authority and was sworn in. Ms. Klinger testified that she is a managing member of the L.L.C. applying for the liquor license. They had previously owned a restaurant in California and are preparing to operate a full service restaurant here in Lakewood. Both her and her husband have reviewed the Colorado Liquor Rules and Regulations and are prepared to attend the City's alcohol training classes.
The public hearing was closed and the Authority entered into a brief discussion amongst themselves.
Mr. Monsoor moved to approve the hotel & restaurant license application of Calo, L.L.C., dba Oliveto Cucina Italiana, 3355 S. Yarrow St. The motion was seconded, and with those present voting Aye, THE MOTION TO APPROVE THE APPLICATION CARRIED.
ITEM 3. SHOW CAUSE HEARING - RECALLED

Shenanigan's Bar & Grill, L.L.C., dba Shenanigan's Bar & Grill

Deputy City Attorney Paul Kennebeck told the Authority a stipulation had been agreed to on this matter. The complaint issued was for the sale of alcohol to a minor and the licensee would admit to the violation. This is the first violation for this licensee and he had explained the standard sanctions to the licensee.
Ed Fleming, 4591 Christian Cir., Littleton, CO 80123, appeared before the Authority and was sworn in. He said he is a managing member of the L.L.C. and would admit to the violation.
Mr. Weakly moved to accept the stipulation between the Deputy City Attorney and Shenanigan's Bar & Grill, L.L.C., dba Shenanigan's Bar & Grill at 5240 S. Wadsworth Blvd. The motion was seconded and with those present voting Aye, THE MOTION TO ACCEPT THE STIPULATION CARRIED.
Mr. Fleming testified that he oversees two restaurants and this is their first violation. The employee who sold the alcohol to the minor was suspended for a two-week period. All employees are T.I.P.S. certified.
Chairman Taake closed the public hearing.
Mr. Wisneski moved that the following penalty be imposed: 10 days suspension with five days held in abeyance for one year to commence August 23, 2002. The balance of the suspension will begin August 23, 2002, at 7:00 a.m. and end on August 28, 2002, at 7:00 a.m. The motion was seconded and with those present voting Aye, THE PENALTY MOTION CARRIED.
ITEM 5. GENERAL BUSINESS
(A) REQUEST FOR EXTENSION OF BOUNDARIES
Deputy City Attorney Paul Kennebeck explained to the Liquor Authority that there has been a request from the law office of Dill, Dill, Carr, Stonbraker, & Hutchings to expand the boundaries of the neighborhood for the "needs and desires" portion of the liquor license application of Jillian's that will be coming before them in the near future. Currently, the neighborhood boundary given to liquor-license applicants is one square mile. The proposed location of the upcoming application is the Colorado Mills site which is very large and just about covers the entire square mile boundary itself. Attorney Kennebeck said that this site is unique and would ask the Authority to instruct the City Clerk's Office to expand the neighborhood to 2 miles square.
Mr. Monsoor moved to expand the boundaries of the neighborhood for any liquor-license applications to be located within the Colorado Mills site of Denver West from one square mile to two miles square. The motion was seconded and with those present voting Aye, THE MOTION TO EXPAND THE BOUNDARIES CARRIED.
ITEM 6. ADJOURNMENT
There being no further business to come before the Liquor Authority at this
time, the meeting adjourned at 8:0 0 p.m.
