NOTICE OF APPLICATION FOR FRANCHISE
BY PUBLIC SERVICE COMPANY OF COLORADO

NOTICE is hereby given that at the regular meeting of the City Council of the City of Lakewood, Jefferson County, State of Colorado, to be held on November 23, 2009, at the hour of 7:00 p.m., City Council Chambers in the City Hall, in the City of Lakewood, Colorado, Public Service Company of Colorado, a corporation duly organized and existing under and by virtue of the laws of the State of Colorado, will make application to said City for the passage of an ordinance granting to said Public Service Company of Colorado a franchise in said City, entitled:

ORDINANCE GRANTING A FRANCHISE BY THE CITY OF LAKEWOOD TO PUBLIC SERVICE COMPANY OF COLORADO, ITS SUCCESSORS AND ASSIGNS, A NONEXCLUSIVE RIGHT TO FURNISH, SELL AND DISTRIBUTE GAS, AND ELECTRICITY TO THE CITY AND TO ALL PERSONS, BUSINESSES AND INDUSTRY WITHIN THE CITY AND ADDITIONAL RIGHTS RELATED THERETO.

The franchise to be applied for will be for a period of  20 years, and shall provide for a franchise fee to the City in the amount of three percent (3%) of all revenues received from the sale of electricity, and (3%) of all Revenues received from the sale and transportation of gas within the City, excluding revenues received from the City for the sale of gas and electricity to the City.
