A RESOLUTION

AUTHORIZNG AN INTERGOVERNMENTAL AGREEMENT WITH THE URBAN DRAINAGE AND FLOOD CONTROL DISTRICT (UFDCD) TO SHARE THE COST OF EASEMENT AND REAL PROPERTY ACQUISITION ON LAKEWOOD GULCH ACROSS THE TOLEN PROPERTIES.

WHEREAS, Lakewood City Council approved resolution R-2006-35 authorizing the acquisition of the Tolen Properties for park, recreation, open space, and drainage purposes; and,

WHEREAS, certain parcels to be acquired are eligible for acquisition cost sharing from UDFCD; and,

WHEREAS, the Jefferson County Open Space Advisory Committee has recommended participation in the acquisition; and,

WHEREAS, the acquisition costs for the eligible parcels has been reasonably determined.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to execute, and the City Clerk to attest, an Intergovernmental Agreement with the Urban Drainage and Flood Control District to share easement and real property acquisition costs for certain portions of the Tolen Properties on Lakewood Gulch upstream of Kipling Street, in form approved by the City Attorney, in an amount not to exceed Sixty-five Thousand and No/100 Dollars ($65,000).

INTRODUCED, READ AND ADOPTED by a vote of 11 for and 0 against at a regular meeting of the City council on June 12, 2006, at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
