AN ORDINANCE
AUTHORIZING CONVEYANCE OF TWO EASEMENTS TO THE FOSSIL RIDGE METROPOLITAN DISTRICT NO. 1; ONE FOR A SANITARY SEWER AND RELATED APPURTENANCES AND THE SECOND ONE FOR IRRIGATION LINES AND RELATED APPURTENANCES, ACROSS PROPERTY OWNED BY THE CITY, LOCATED WITHIN TRACTS H, K, J AND L, SOLTERRA SUBDIVISION FILING NO. 2
WHEREAS, the Fossil Ridge Metropolitan District No. 1 has requested that the City of Lakewood convey to said District two easements across City owned land; one easement for a sanitary sewer line and related appurtenances to serve homes within the eastern portion of the Solterra development, the second easement for irrigation lines and related appurtenances which are necessary for the installation and ongoing maintenance of landscaping within City owned tracts, public rights of way and District owned property; and
WHEREAS, said land was conveyed to the City by Carma Lakewood, LLC for park or open space purposes; and
WHEREAS, Section 14.3 of the Charter of the City of Lakewood provides that easements may be granted across park land, and the City Council desires to do so in this instance.
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, that:
SECTION 1. The City Manager is hereby authorized to execute and the City Clerk
to attest an easement, in form approved by the City Attorney, to the Fossil
Ridge Metropolitan District No. 1 across the land described in Exhibit "A"
attached hereto and made a part hereof, for a sanitary sewer line and related
appurtenances and further hereby authorized to execute and the City Clerk to
attest a second easement, in form approved by the City Attorney, to the Fossil
Ridge Metropolitan District No. 1 across the land described in Exhibit "B"
attached hereto and made a part hereof, for irrigation lines and related appurtenances.
SECTION 2. This Ordinance shall take effect thirty (30) days after final publication.
I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 27th day of October, 2008; published by title in the Rocky Mountain News and in full on the City of Lakewood's website, www.lakewood.org., on the 30th day of October, 2008; set for public hearing on the 10th day of November, 2008; read, finally passed and adopted by the City Council on the 10th day of November, 2008, and signed, and approved by the Mayor on the 11th day of November, 2008.
