A RESOLUTION

AUTHORIZING A REVOCABLE LICENSE AGREEMENT BETWEEN THE CITY OF LAKEWOOD AND ANTHONY A. RITSMA ACROSS A PORTION OF LOVELAND TRAIL PARK ADJACENT TO THAT PROPERTY LOCATED AT 2293 SOUTH COORS STREET, TO ALLOW FOR A SUBSURFACE SIX INCH PIPE AND RELATED FACILITIES TO CONVEY GROUND WATER FROM THE PROPERTY AT 2293 SOUTH COORS STREET TO A DRAINAGE STRUCTURE LOCATED IN SAID LOVELAND TRAIL PARK.

WHEREAS, Anthony A. Ritsma has requested a Revocable License Agreement from the City of Lakewood to allow placement of subsurface pipe to convey ground water from his residence at 2293 South Coors Street and related facilities to an existing drainage structure located on land owned by the City and used as Loveland Trail Park; and

WHEREAS, the City wishes to allow said use of the portion of said park as described in Exhibit "A" attached hereto and made a part hereof, for installation, maintenance and replacement of subsurface pipe line and related facilities in accordance with the terms and conditions of a Revocable License Agreement issued by the City.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to execute, and the City Clerk to attest, a Revocable License Agreement between the City of Lakewood and Anthony A. Ritsma, in form approved by the City Attorney, for the use described above of the City-owned park described in Exhibit "A" hereto.

INTRODUCED, READ AND ADOPTED by a vote of 11 For and 0 Against at a regular meeting of the City Council on October 8, 2007, at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.

Exhibit A

A parcel of land lying in the Northeast One-quarter (NE1/4) of Section 30, Township 4 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, more particularly described as follows:

A parcel of land ten feet in width lying five feet on each side of the following described centerline:

Commencing at a northeasterly corner of Tract A, HUTCHINSONS GREEN MOUNTAIN VILLAGE FILING NO. 38, the plat of which is recorded in Plat Book 55, at Page 46, of the records of the Jefferson County Clerk and Recorder, said northeasterly corner being in common with the Southwest corner of Lot 39, Block 212, said HUTCHINSONS GREEN MOUNTAIN VILLAGE FILING NO. 38, said corner also lying on the westerly right-of-way line of South Coors Street as shown on said HUTCHINSONS GREEN MOUNTAIN VILLAGE FILING NO. 38; thence westerly along the southerly line of said Lot 39, a distance of 25.00 feet to the True Point of Beginning of the herein described centerline; thence southerly along a line, a distance of 69.00 feet, more or less, to the intersection of said centerline with the northerly wing wall of that existing drainage structure located in said Tract A, said drainage structure being located 25.00 feet, more or less, westerly of the westerly right-of-way line of said South Coors Street, said intersection being the point of terminus of the herein described centerline.

This was based on the recorded plat of said HUTCHINSONS GREEN MOUNTAIN VILLAGE FILING NO. 38.
