A RESOLUTION

AUTHORIZING AN AGREEMENT WITH THE PLAZA METROPOLITAN DISTRICT NO. 1 AND CONTINUUM LAKEWOOD DEVELOPMENT COMPANY, LLC REGARDING ON-STREET PAY PARKING AT BELMAR.

WHEREAS, the Belmar development includes a mix of uses including residential, commercial and office space that is uniquely configured within the City of Lakewood (City); and,

WHEREAS, the parking options for patrons of Belmar will include parking structures, parking lots, and on-street parking; and,

WHEREAS, The Plaza Metropolitan District (District) and Continuum Lakewood Development Company, LLC (Continuum) will own and manage the parking structures and parking lots comprising approximately 95% of the parking spaces available at Belmar; and,

WHEREAS, the City recognizes the need to actively manage parking options at Belmar to encourage the availability of the most convenient on-street parking spaces for short duration visits to Belmar and to encourage the use of parking garages and parking lots for longer duration visits; and,

WHEREAS, Chapter 10.37 of the Lakewood Municipal Code authorizes the Lakewood City Council to delegate authority to operate and maintain an on-street parking system; and,

WHEREAS, the City, District and Continuum desire to enter into an agreement for managing on-street pay parking which will provide approximately 5% of the parking spaces available at Belmar.

NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to execute and the City Clerk attest an agreement, in form approved by the City Attorney, with The Plaza Metropolitan District No. 1 and Continuum Lakewood Development Company, LLC for the purpose of managing on-street pay parking at Belmar.

INTRODUCED, READ AND ADOPTED by a vote of 8 for and 3 against at a regular meeting of the City Council on April 12, 2004, at 7 o'clock p.m. at Lakewood Civic Center South, 480 South Allison Parkway, Lakewood, Colorado.
