AN ORDINANCE

APPROVING AND AUTHORIZING A SUPPLEMENTAL APPROPRIATION TO FUND THE CONVERSION OF TRAFFIC SIGNAL LIGHTING AND LIGHTING OF ARTERIAL STREETS TO A MORE COST AND ENERGY EFFICIENT SYSTEM

WHEREAS, the City Council of the City of Lakewood has by Ordinance No. 0-2003-29 adopted a budget for the City of Lakewood for the fiscal year beginning January 1, 2004 and ending on December 31, 2004 and has appropriated sums of money consistent therewith; and

WHEREAS, pursuant to the Charter, the City Council may make supplemental appropriations during the fiscal year for unanticipated expenditures required for the operation of the City provided the aggregate of such supplemental appropriations made during the fiscal year does not exceed the amount by which actual and anticipated revenues for the fiscal year are exceeding the revenues as estimated in the adopted budget, or as such monies not anticipated in the adopted budget may otherwise become available to the City; and

WHEREAS, the City Council wishes to appropriate sums of money to fund the conversion of traffic signal lights to Lighting Emitting Diode (LED) bulbs and certain arterial street lights to uniform standard lower wattage output.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:

Section 1. The City Council finds there are contingencies which could not have been reasonably foreseen at the time of the adoption of the budget for the fiscal year beginning January 1, 2004 and ending December 31, 2004.

Section 2. The City Council hereby appropriates the sum of $950,000 from the Capital Improvement Fund to fund the conversion of traffic signal lights and certain arterial street lights to Light Emitting Diode (LED) bulbs.

Section 3. Funding for this appropriation will be provided from a lease purchase contract.

Section 4. This ordinance shall take effect thirty (30) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 28th day of June, 2004; published in full in the Jefferson Sentinel on the 1st day of July, 2004; set for public hearing on the 12th day of July, 2004; read, finally passed and adopted by the City Council on the 12th day of July, 2004; and, signed and approved by the Mayor on the 13th day of July, 2004.
