A RESOLUTION

ESTABLISHING PROCESSING FEES FOR EASEMENTS, LICENSE AGREEMENTS AND OTHER USES OF CITY PROPERTY.

WHEREAS, Ordinance O-2002-20 modified the Lakewood Municipal Code to allow fees to be established to offset the cost of reviewing requests for easements, license agreements and other uses of City property; and,

WHEREAS, the newly created Section 1.26.30 requires that said fees be established by resolution adopted by City Council; and,

WHEREAS, the proposed fees are approximately equal to the cost to review a typical request for an easement, license agreement or other use of City owned property.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The following fees shall be applied to any request for easements, license agreements or other requests to use City owned property or rights-of-way:
a. Any request for an easement, license agreement or other use of City owned property or right-of-way which is prepared on a standard City of Lakewood document, $250.00.
b. Any request for an easement, license agreement or other use of City owned property or right-of-way which is not prepared on a standard City of Lakewood document, $500.00.

SECTION 2. The following types of uses are exempt from the above fees:
a. Easements required to serve City facilities or projects.
b. Requests for easements or license agreements to use City property, which are not a result of any action or request made by the applicant.
c. Requests for use of City-owned property or right-of-way for any event or program sponsored by the City.

SECTION 3. The fees established herein shall become effective on the effective date of Ordinance O-2002-20.
