A RESOLUTION

AUTHORIZING A REVOCABLE LICENSE AGREEMENT BETWEEN THE CITY OF LAKEWOOD AND ROSEMARIE D. RANKIN AND JOHN W. RANKIN, ALONG THE SOUTH SIDE OF WEST RADCLIFF AVENUE ADJACENT TO THE PROPERTY LOCATED AT 7400 WEST RADCLIFF AVENUE

WHEREAS, Rosemarie D. Rankin and John W. Rankin, have requested a Revocable License Agreement from the City of Lakewood to allow for an existing planter box and rock pillar for a mailbox to remain on land owned by the City as a portion of West Radcliff Avenue; and

WHEREAS, the City wishes to allow said use of the portion of said street right-of-way as described in Exhibit "A" attached hereto and made a part hereof, for maintenance and replacement of a planter box and rock pillar for a mailbox in accordance with the terms and conditions of a Revocable License Agreement issued by the City.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to execute, and the City Clerk to attest, a Revocable License Agreement between the City of Lakewood and Rosemarie D. Rankin and John W. Rankin, in form approved by the City Attorney, for the use described above in the City-owned street right-of-way described in Exhibit "A" hereto.

INTRODUCED, READ AND ADOPTED by a vote of 10 for and 0 against at a regular meeting of the City Council on May 13, 2002, at 7 o'clock p.m. at Lakewood City Hall, 480 South Allison Parkway, Civic Center South, Lakewood, Colorado.

Exhibit "A"

A parcel of land lying in the Northeast One-quarter (NE¼) of Section 11, Township 5 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, more particularly described as follows:

Commencing at the Northeast corner of Lot 38, RESUBDIVISION OF LOCHMOOR SUBDIVISION, the plat of which is recorded in Plat Book 16, at Page 35, of the records of the Jefferson County Clerk and Recorder; thence northwesterly along the northerly extended easterly line of said Lot 38, a distance of 7.00 feet to the True Point of Beginning; thence continuing northwesterly along said extended easterly line, a distance of 11.00 feet; thence southwesterly along a line parallel with the southerly line right-of-way line of West Radcliff Avenue, said southerly right-of-way line being in common with the northerly line of said Lot 38, a distance of 6.00 feet; thence southeasterly along a line parallel with said extended easterly line, a distance of 10.00 feet; thence northeasterly along a line parallel with said southerly right-of-way line, a distance of 6.00 feet, more or less, to the True Point of Beginning.
