A RESOLUTION

AUTHORIZING AWARD OF A CONTRACT FOR RECONSTRUCTION OF MISSISSIPPI AVENUE FROM PIERCE TO SHERIDAN TO THE LOWEST RESPONSIVE, RESPONSIBLE, QUALIFIED BIDDER.

WHEREAS, the Capital Improvement and Preservation Program includes reconstruction of Mississippi Avenue from Pierce Street to Sheridan Boulevard in 2002 including installation of approximately 3200 feet of pipe to replace an open irrigation ditch; and,

WHEREAS, installation of the pipe will be less costly, less disruptive, and more efficient if it is completed prior to the beginning of irrigation season; and,

WHEREAS, to complete the pipe installation prior to irrigation season it is necessary to award the construction contract as soon after bids are opened as possible.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to enter into, and the City Clerk to attest, a contract, in form approved by the City Attorney, for reconstruction of Mississippi from Pierce to Sheridan without further City Council action provided the following conditions are met:

a) The contractor that provides the lowest bid is responsive, responsible and qualified.
b) The lowest bid is within the budget in the Capital Improvement and Preservation Program.
c) The lowest bid is within the Engineer's Estimate of the project cost.

SECTION 2. Said contract shall be for an amount not to exceed the low bid received. An additional 10% of the low bid amount is hereby authorized for change orders, if needed.

SECTION 3. The City Finance Director is hereby authorized to make payment in accordance with the terms of said contract.

INTRODUCED, READ AND ADOPTED by a vote of 11 for and 0 against at a regular meeting of the City Council on February 25, 2002 at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
