AN ORDINANCE
AN ORDINANCE FOR ACCEPTANCE OF A COMMISSIONERS DEED, FROM THE JEFFERSON COUNTY COMMISSIONERS TO THE CITY OF LAKEWOOD FOR THE WEST ONE-HALF OF YARROW STREET RIGHT-OF-WAY AND FURTHER AUTHORIZING THE CITY TO CONVEY THAT PORTION OF SAID YARROW STREET RIGHT-OF-WAY THAT HAS AN EXISTING BUILDING AND SITE IMPROVEMENTS WITHIN THE RIGHT-OF-WAY TO THE HOUSING AUTHORITY OF THE CITY OF LAKEWOOD; FURTHER DECLARING AN EMERGENCY.
WHEREAS, Jefferson County Commissioners, has tendered to the City of Lakewood its Commissioners Deed dated November 19, 2002, and recorded on November 25, 2002, at Reception Number F1616262, and re-recorded at Reception Number F162131368, of the records of the Jefferson County Clerk and Recorder, conveying right-of-way for the West One-half of Yarrow Street between West 14th Avenue and West 13th Avenue; and
WHEREAS, the City Council wishes to have the City of Lakewood execute a Quit Claim Deed in a format acceptable to the City Attorney to The Housing Authority of the City of Lakewood for that portion of the Yarrow Street right-of-way described in Exhibit "A" attached hereto and made a part hereof; and
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:
SECTION 1. The City of Lakewood does hereby accept, for municipal purposes, the aforesaid Commissioners Deed bearing acknowledgment dated November 19, 2002.
SECTION 2. The Mayor is authorized to execute a Quit Claim Deed to The Housing Authority of the City of Lakewood in a format acceptable to the City Attorney.
SECTION 3. The City Clerk is authorized and directed to record a certified copy of this Ordinance with the Jefferson County Clerk and Recorder.
SECTION 4. Emergency. This ordinance is necessary for the immediate preservation
of the City of Lakewood's peace, health and safety. The presence of the need
to assist in the expedition of the purchase of the property by The Housing Authority
of the City of Lakewood constitutes an emergency and requires that this Ordinance
take effect immediately.
I hereby attest and certify that the within and foregoing ordinance was introduced
and read on first reading at a regular meeting of the Lakewood City Council
on the 9th day of December, 2002; published in full in the Lakewood Sentinel
on the 12th day of December, 2002; set for public hearing on the 13th day of
January, 2003; read, finally passed and adopted by the City Council on the 13th
day of January, 2003; and signed and approved by the Mayor on the 14th day of
January, 2003.

Exhibit "A"
A parcel of land lying in the Northwest One-quarter (NW¼) of Section 2, Township 4 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, more particularly described as follows:
Commencing at the Northeast corner of Block 74, LAKEWOOD, the plat of which is recorded in Plat Book 2, at Pages 14 and 15, of the records of the Jefferson County Clerk and Recorder, said Northeast corner being in common with the Northwest corner of that tract of land conveyed to the City of Lakewood described in that instrument recorded at Reception Number F162131368, of said records; thence southerly along the East line of said Block 74, said East line being in common with the West line of said tract, a distance of 343.00 feet to the True Point of Beginning; thence continuing southerly along said East line, a distance of 123.50 feet, more or less, to a point that is 133.5 feet northerly along said East line from the Southeast corner of said Block 74, said point also being in common with the Southwest corner of said tract and also lying on the North line of Parcel A of that tract of land described in that instrument recorded at Reception Number F0292757; thence easterly along the South line of that tract described in said Reception Number F162131368, said South line being parallel with the easterly extended South line of said Block 74, and in common with the North line of said Parcel A, a distance of 30.00 feet, more or less, to the intersection of the South line of that tract described in said Reception Number F162131368, with the platted centerline of Yarrow Street as shown and platted on said LAKEWOOD subdivision, said intersection being in common with the Southeast corner of said last tract and the Northeast corner of said Parcel A; thence northerly along said centerline, said centerline being in common with the East line of that tract described in said Reception Number F162131368, a distance of 123.50 feet; thence westerly along a line parallel with the easterly extended South line of said Block 74, a distance of 30.00 feet, more or less, to the point of beginning. RESERVING HOWEVER an easement over the above described parcel EXCEPT for the South 36.9 feet of the West 6.00 feet thereof for existing sanitary sewer facilities and for existing overhead utilities.
