A BILL FOR AN

ORDINANCE TO VACATE A PORTION OF ARBUTUS DRIVE ADJACENT TO THE PROPERTY AT 13300 WEST SIXTH AVENUE, CITY OF LAKEWOOD, COUNTY OF JEFFERSON, STATE OF COLORADO

WHEREAS, a roadway easement for Arbutus Drive was conveyed to the City of Lakewood for public access to Red Rocks Community College from West Sixth Avenue South Frontage Road to the South property line of the Red Rocks Community College property.

WHEREAS, a portion of Arbutus Drive has been re-aligned between the entrance to Red Rocks College and West 2nd Avenue.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, That:

SECTION 1. A portion of the West Arbutus Drive right-of-way is no longer used by the public as access and is no longer necessary.

SECTION 2. The City is reserving however an easement over the described area in Exhibit "A" for service and emergency vehicles access and for existing above and below ground utility facilities.

SECTION 3. Pursuant to Title 43, Article 2, Colorado Revised Statutes, Case No. VA-02-003, and upon a finding that the described area is no longer necessary for use by the public and that no land would by a vacation be left without an established public road connecting same with another established public road, the property described in Exhibit "A" attached hereto be and the same is hereby vacated.

SECTION 3. This ordinance shall take effect thirty (30) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 28th day of October, 2002; published in full in the Lakewood Sentinel on the 31st day of October, 2002; set for public hearing on the 25th day of November, 2002; read, finally passed and adopted by the City Council on the 25th day of November, 2002; and signed and approved by the Mayor on the 26th day of November, 2002.

EXHIBIT "A"
Legal Description

A parcel of land lying in the Northeast One-quarter (NE¼) and the Southeast One-quarter (SE) of Section 7, Township 4 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, more particularly described as follows:

Commencing at the Southeast corner of said NE¼; thence S 00º00'34" E along the East line of said SE¼, a distance of 430.69 feet; thence S 89º46'51" W, a distance of 651.99 feet, more or less, to the Southeast corner of that right-of-way conveyance to the City of Lakewood for Arbutus Street as described in said Reception Number 87117420, said corner being the True Point of Beginning; thence westerly and northerly along the southerly and westerly right-of-way line of said Arbutus Street the following three courses:

1. thence S 89º46'51" W, a distance of 126.31 feet;

2. thence N 37º53'01" E, a distance of 588.24 feet to a point of curve;

3. thence northeasterly along the arc of a curve to the left having a radius of 335.00 feet, a central angle of 18º53'57", (whose long chord bears N 28º26'03" E, a long chord distance of 110.00 feet) a arc length of 110.50 feet;

thence leaving said West right-of-way line S 74º01'03" E, a distance of 100.11 feet, more or less, to a point on a curve on the East right-of-way line of said Arbutus Street; thence southerly along said East right-of-way line the following two courses:

1. southwesterly along the arc of a curve to the right having a radius of 435.00 feet, a central angle of 19º35'19", (whose long chord bears
S 28º05'22" W, a long chord distance of 148.00 feet), a arc length of 148.72 feet to a point of tangency;

2. thence S 37º53'01" W along said tangent, a distance of 511.07 feet, more or less, to the True Point of Beginning, the above described parcel contain an area of 69,855 square feet, more or less. RESURVING an easement over the above described land for access for service and emergence vehicles and for existing above or below ground utilities.
