ORDINANCE

AMENDING MUNICIPAL WARD BOUNDARIES FOR THE CITY OF LAKEWOOD, COLORADO

WHEREAS, ordinance O-97-50 last established boundaries for wards and precincts in the City of Lakewood, pursuant to Section 2.7 of the Lakewood Home Rule Charter; and

WHEREAS, the 2000 decennial U.S. Census Data shows a 15% deviation in population between the largest (Ward 5) and smallest (Ward 3) wards; and

WHEREAS, the City Council wishes to make the population as evenly distributed among the five wards as practicable with as little disruption to as few citizens as possible; and

WHEREAS, the City Council wishes to achieve this equalization of ward population by placing General Precinct Number 7212630010 in Ward 3; and

WHEREAS, the Jefferson County Clerk and Recorder, in meeting constitutional apportionment requirements, has established General Precinct Number 7212230008 lies in both Ward 4 and Ward 5 and it is necessary to place said precinct in either Ward 4 or Ward 5 and the City Council wishes to place said General Precinct Number 7212230008 in Ward 4; and

WHEREAS, the Jefferson County Clerk and Recorder, in meeting constitutional apportionment requirements, has established General Precinct Number 7202630001 lies in both Ward 1 and Ward 4 and it is necessary to place said precinct in either Ward 1 or Ward 4 and the City Council wishes to place said General Precinct Number 7202630001 in Ward 1; and

WHEREAS, the Jefferson County Clerk and Recorder, in meeting constitutional apportionment requirements, has established General Precinct Number 7222230002 lies in both Ward 4 and Ward 5 and it is necessary to place said precinct in either Ward 4 or Ward 5 and the City Council wishes to place said General Precinct Number 7222230002 in Ward 5; and

WHEREAS, it is necessary to establish Municipal Precincts to include whole general precincts that are based on the convenience of the voters.

NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Lakewood, that:

SECTION 1. The City ward boundaries are hereby changed so that each of the wards of the City shall consist of and contain the general election precincts listed opposite the number of each ward on Exhibit "A" attached hereto and made a part hereof; however, that no portion of any general election precinct lying outside of the boundaries of the City of Lakewood shall constitute a part of any ward of the City.

SECTION 2. The City Council hereby finds and determines that the wards as provided herein are as compact and as equal in population as is practicable, taking into consideration the need to follow general election precinct lines, and the nature and characteristics of the City of Lakewood.

SECTION 3. The Municipal Election Precincts are hereby changed so that each of the municipal election precincts consist of and contain the general election precincts listed opposite the number of each ward and municipal election precinct number as shown on Exhibit "B" attached hereto and made part hereof.

SECTION 4. This ordinance shall take effect thirty (30) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 9th day of September, 2002; published in full in the Lakewood Sentinel on the 12th day of September, 2002; set for public hearing on the 23rd day of September, 2002; read, finally passed and adopted by the City Council on the 23rd day of September, 2002; and signed and approved by the Mayor on the 24th day of September, 2002.
