AN ORDINANCE
AUTHORIZING THE CONVEYANCE OF A QUIT CLAIM DEED FOR 20 FEET OF PROPERTY SOUTH OF 8525 W. ALAMEDA AVENUE IN EXCHANGE FOR A QUIT CLAIM DEED FROM THE PROPERTY OWNER FOR THE 30 FEET NORTH OF THE SECTION LINE ADJACENT TO THE SAME PROPERTY LOCATED IN THE SOUTHEAST ONE-QUARTER OF SECTION 10, TOWNSHIP 4 SOUTH, RANGE 69 WEST OF THE 6TH PRINCIPAL MERIDIAN, CITY OF LAKEWOOD, COUNTY OF JEFFERSON, STATE OF COLORADO, FURTHER DECLARING AN EMERGENCY.
WHEREAS, the Title to the 50 feet of property adjacent to West Alameda Avenue between Carr Street and Cody Street is disputed; and,
WHEREAS, the owner of the adjacent real property, Alameda Hills Baptist Church, and the City of Lakewood desire to settle the dispute amicably; and,
WHEREAS, the City of Lakewood agrees to quit claim the property described in attached Exhibit A in exchange for Alameda Hills Baptist Church providing a quitclaim deed for the property described in Exhibit B.
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, that:
SECTION 1. The City Manager is authorized to sign and the City Clerk is authorized to attest a Quit Claim deed for the parcel of land described in Exhibit A, which is attached hereto and incorporated herein by this reference to Alameda Hills Baptist Church in exchange for Alameda Hills Baptist Church providing a quit claim deed for the parcel of land which is described in attached Exhibit B, which is attached hereto and incorporated herein by this reference.
SECTION 2. The City Manager, through the Property Management Division, is authorized to accept the conveyance of the property described in Exhibit B for right-of-way purposes.
SECTION 3. Emergency. This ordinance is necessary for the immediate preservation of the City of Lakewood's peace, health and safety. The clarification of ownership of right-of-way is essential.
I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 12th day of August, 2002; published in full in the Lakewood Sentinel on the 15th day of August, 2002; set for public hearing on the 26th day of August, 2002; read, finally passed and adopted by the City Council on the 26th day of August, 2002; and signed and approved by the Mayor on the 27th day of August, 2002.

EXHIBIT A
A parcel of land located in the Southeast One-quarter (SE1/4) of Section 10, Township 4 South, Range 69 West of the 6th Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, more particularly described as follows:
Commencing at the Southeast corner of said SE1/4; thence easterly along the South line of said SE1/4 a distance of 354.80 feet, to the intersection of the southerly extended West right-of-way line of South Cody Street as shown in the plat of WEST ALAMEDA HILLS SUBDIVISION which is recorded in Plat Book 165, at Page 7 of the records of the Jefferson County Clerk and Recorder with said South line; thence, northerly along said extended West right-of-way line, a distance of 30 feet to the TRUE POINT OF BEGINNING; thence continuing northerly along said extended West right-of-way line, a distance of 20.00 feet, more or less to the southeast corner of Lot 1 Block 1 of said subdivision, thence westerly along the south line of said Lot 1, Block 1, a distance of 304.81 feet, more or less, to the southwest corner of said Lot 1; thence southerly along the southerly extended west property line of said Lot 1, a distance of 20.00 feet, more or less, to a point that lies 30.00 feet northerly along said extended west property line from the South line of said SE1/4; thence easterly and parallel with the South line of said SE1/4, a distance of 304.81 feet, more or less, to the TRUE POINT OF BEGINNING.
Said Parcel contains 6,096.2 square feet (.14 acres) more or less.

A parcel of land located in the Southeast One quarter (SE1/4) Section 10, Township 4 South, Range 69 West of the 6th Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, more particularly described as follows:
Commencing at the Southeast corner of said SE1/4; thence easterly along the South line of said SE1/4 a distance of 329.80 feet, to the intersection of the southerly extended centerline of South Cody Street as shown in the plat of WEST ALAMEDA HILLS SUBDIVISION which is recorded in Plat Book 165, at Page 7 of the records of the Jefferson County Clerk and Recorder and the TRUE POINT OF BEGINNING thence, northerly along said extended centerline, a distance of 30 feet; thence westerly along a line running parallel with said south line, a distance of 329.81 feet, more or less, to the southerly extended west property line of said Lot 1 as shown in said WEST ALAMEDA HILLS SUBDIVISION; thence southerly along said extended west property line a distance of 30.00 feet, more or less, to a point on the South line of said SE1/4; thence easterly along the South line of said SE1/4, a distance of 329.81 feet, more or less, to the TRUE POINT OF BEGINNING.
Said Parcel contains 9,894.3 square feet (.227 acres) more or less.
