AN ORDINANCE

ZONE LAND LOCATED AT 12305 WEST DAKOTA AVENUE CITY OF LAKEWOOD, COLORADO

Be it Ordained by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. Upon the application of Kenneth Breitkreuz, in Lakewood Zoning Case No. RZ-02-001, and upon a recommendation of approval from the Lakewood Planning Commission, Lakewood Zoning Maps are hereby amended to include in the PD (Planned Development) zoning district for the construction of an a new office, warehouse, and ware yard, and exclude from the OF (Office) zone district, the property described in Exhibit A attached hereto, and made a part thereof.

SECTION 2. The City Council of the City of Lakewood hereby approves the Public Improvements Agreement between Kenneth Breitkreuz and the City of Lakewood.

SECTION 3. The City Manager is hereby authorized to execute and the City Clerk to attest the Public Improvements Agreement with Kenneth Breitkreuz in the form approved by the City Attorney. Following execution of the Public Improvements Agreement, the City Clerk is hereby authorized to file said Public Improvements Agreement with the Clerk and Recorder of Jefferson County, Colorado.

SECTION 4. This ordinance shall take effect forty-five (45) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 8th day of July, 2002; published in full in the Jefferson Sentinel on the 11th day of July, 2002; set for public hearing on the 22nd day of July, 2002; read, finally passed and adopted by the City Council on the day of July, 2002; and signed and approved by the Mayor on the day of July, 2002.

LEGAL DESCRIPTION
A part of the Northwest One-Quarter (NW¼) of Section 17, Township 4 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, being more particularly described as follows:
