AN ORDINANCE

AUTHORIZING THE CONVEYANCE OF A 320 ACRE PARCEL OF LAND TO JEFFERSON COUNTY, AUTHORIZING THE ACCEPTANCE OF A COMMISSIONERS DEED WITH A REVERSIONARY INTEREST CLAUSE FOR THE SAME PROPERTY LOCATED IN THE SOUTH ONE HALF OF SECTION 13, TOWNSHIP 4 SOUTH, RANGE 70 WEST OF THE 6TH PRINCIPAL MERIDIAN, CITY OF LAKEWOOD, COUNTY OF JEFFERSON, STATE OF COLORADO, FURTHER DECLARING AN EMERGENCY

WHEREAS, Jefferson County (County) acquired five separate parcels of land with the use of open space funds (Released Property) and conveyed these parcels to the City of Lakewood (City) while reserving a reversionary interest in order to insure the preservation of these properties for open space, park and recreation purposes; and,

WHEREAS, in order to fund the construction of recreation centers and other public facilities funded by the 2000 Certificates of Participation, the City requested that the County release the reversionary interests; and,

WHEREAS, the City and the County entered into an Intergovernmental Agreement (IGA) whereby the County agreed to release the reversionary interest in the Released Property on the condition that the City convey a replacement property of approximately equal value (Replacement Property) to the County, the County would re-convey the property back to the City with a reversionary interest; and,

WHEREAS, the City of Lakewood is the owner of a 320 acre parcel of land which is part of the property commonly known as William Fredrick Hayden Green Mountain Park, 315 acres of which is not presently subject to any reversionary interest to Jefferson County and is approximately equal in value to the Released Property; and,

WHEREAS, the conveyance of said parcel to establish a reversionary interest to be held by the County reaffirms and reinforces the regulations established by Section 14.3(b) of the Lakewood City Charter which is intended to assure the preservation of property acquired for open space and park purposes.

NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, that:

SECTION 1. The City Manager is authorized to sign and the City Clerk is authorized to attest a deed conveying 320 acres as described in Exhibit "A", which is attached hereto and incorporated herein by this reference, to Jefferson County to fulfill the City's obligations under the IGA.

SECTION 2. The City Manager, through the Property Management Division, is authorized to accept the conveyance of the property described in Exhibit "A" for Park and Open Space Purposes.

SECTION 3. This ordinance shall take effect thirty (30) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 24th day of June, 2002; published in full in the Lakewood Sentinel on the 27th day of June, 2002; set for public hearing on the 8th day of July, 2002; read, finally passed and adopted by the City Council on the 8th day of July, 2002; and signed and approved by the Mayor on the 9th day of July, 2002.

A parcel of land lying in, Section 13, Township 4 South, Range 70 West of the 6th Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, more particularly described as follows:

The south one?half (S 1/2) of said Section 13. Said parcel of land contains 320, more or less.

The foregoing legal description was drafted by Michael J. Connor, Property Manager for the City of Lakewood based upon that instrument recorded in Book 2452 at Page 297.
