AN ORDINANCE

AMENDING SECTION 1.26 BY ADDING A SECTION 1.26.030 OF THE LAKEWOOD MUNICIPAL CODE REGARDING REVIEW AND USE FEES FOR REQUESTS FOR LICENSE AGREEMENTS, EASEMENTS AND OTHER USES OF CITY PROPERTY

WHEREAS, the Lakewood Municipal Code allows for fees to be charged for City services; and,

WHEREAS, Lakewood receives requests by private persons and other entities for specified uses such as License Agreements, Easements and other uses of City-owned real property and rights-of-way; and,

WHEREAS, the processing, administration and oversight of these requests results in expenses to the City; and,

WHEREAS, These expenses should be borne by the individual or entity benefiting from the request as opposed to all taxpayers.

NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, that:

SECTION 1. Section 1.26 of the Lakewood Municipal Code shall be amended by adding Section 1.26.030 to read as follows:

1.26.30 Review, use and administrative fee - Use of City-owned real property.

Any person who presents a request for City Council or administrative approval for the use, encroachment or encumbrance of City-owned real property shall pay an application, review, use, permit and/or administrative fee in an amount to be established by City Council by resolution.

SECTION 2. This ordinance shall take effect thirty (30) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 24th day of June, 2002; published in full in the Lakewood Sentinel on the 27th day of June, 2002; set for public hearing on the 8th day of July, 2002; read, finally passed and adopted by the City Council on the 8th day of July, 2002; and signed and approved by the Mayor on the 9th day of July, 2002.
