AN ORDINANCE

AUTHORIZING THE CONVEYANCE OF A QUIT CLAIM DEED FOR 20 FEET OF PROPERTY SOUTH OF 8405 W. ALAMEDA AVENUE IN EXCHANGE FOR A QUIT CLAIM DEED FROM THE PROPERTY OWNER FOR THE 30 FEET NORTH OF THE SECTION LINE ADJACENT TO THE SAME PROPERTY LOCATED IN THE SOUTHEAST ONE-QUARTER OF SECTION 10, TOWNSHIP 4 SOUTH, RANGE 69 WEST OF THE 6TH PRINCIPAL MERIDIAN, CITY OF LAKEWOOD, COUNTY OF JEFFERSON, STATE OF COLORADO.

WHEREAS, the Title to the 50 feet of property adjacent to West Alameda Avenue between Carr Street and Cody Street is disputed; and,

WHEREAS, the owner of the adjacent real property, Total Longterm Care Inc., and the City of Lakewood desire to settle the dispute amicably; and,

WHEREAS, the City of Lakewood agrees to quit claim the property described in attached Exhibit "A" in exchange for Total Longterm Care providing a quitclaim deed for the property described in Exhibit "B".

NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, that:

SECTION 1. The City Manager is authorized to sign and the City Clerk is authorized to attest a Quit Claim deed for the parcel of land described in Exhibit "A", which is attached hereto and incorporated herein by this reference to Total Longterm Care, Inc. in exchange for Total Longterm Care, Inc., providing a quit claim deed for the parcel of land which is described in attached Exhibit "B", which is attached hereto and incorporated herein by this reference.

SECTION 2. The City Manager, through the Property Management Division, is authorized to accept the conveyance of the property described in Exhibit "B" for right-of-way purposes.

SECTION 3. This ordinance shall take effect thirty (30) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 24th day of June, 2002; published in full in the Lakewood Sentinel on the 27th day of June, 2002; set for public hearing on the 8th day of July, 2002; read, finally passed and adopted by the City Council on the 8th day of July, 2002; and signed and approved by the Mayor on the 9th day of July, 2002.

EXHIBIT A

A parcel of land located in the Southeast One-quarter (SE1/4) of Section 10, Township 4 South, Range 69 West of the 6th Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, more particularly described as follows:

Commencing at the Southeast corner of said SE1/4; thence easterly along the South line of said SE1/4 a distance of 30 feet, to the intersection of the southerly extended West right-of-way line of South Carr Street as shown in the plat of WEST ALAMEDA HEIGHTS which is recorded in Plat Book 7, at Page 44 of the records of the Jefferson County Clerk and Recorder with said South line; thence, northerly along said extended West right-of-way line, a distance of 30 feet to the TRUE POINT OF BEGINNING; thence continuing northerly along said extended West right-of-way line, a distance of 50.00 feet, more or less, to a platted point of curve on the East line of Lot 13, Block 9, said WEST ALAMEDA HEIGHTS; thence southwesterly along the arc of said platted curve, said curve being a curve to the right and being concave to the northwest and having a radius of 30.00 feet to a platted point of tangency on the south line of said Lot 13; thence westerly along the south line of Lot 13 and Lot 12, said Block 9, a distance of 210.2 feet, more or less, to a platted point of curve; thence northwesterly along the arc of said platted curve, said curve being to the right and having a radius of 30.00 feet to a platted point of tangency on the West line of said Lot 12, said West line being in common with the East right of way line of South Cody Street; thence southerly along the southerly extended East right-of-way line of South Cody Street as shown in said WEST ALAMEDA HEIGHTS, a distance of 50.00 feet, more or less, to a point that lies 30.00 feet northerly along said extended East right-of-way line from the South line of said SE1/4; thence easterly and parallel with the South line of said SE1/4, a distance of 270.2 feet, more or less, to the TRUE POINT OF BEGINNING.

Said Parcel contains 5,597.14 square feet (.128 acres) more or less.
