AN ORDINANCE

TO APPROVE A SITE SPECIFIC DEVELOPMENT PLAN IN CONJUNCTION WITH REZONING CASE RZ-01-006 FOR LAND LOCATED AT 7200 WEST ALAMEDA AVENUE, 6900/6960 WEST ALAMEDA AVENUE, 344/355 SOUTH PIERCE ST AND 398 SOUTH REED STREET, CITY OF LAKEWOOD, JEFFERSON COUNTY, COLORADO

BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. Upon the application of City Manager, Michael J. Rock, in conjunction with Lakewood Zoning Case No. RZ-01-006, and upon a recommendation of approval from the Lakewood Planning Commission, the Lakewood City Council hereby approves a Site Specific Development Plan to authorize vested property rights, pursuant to Article 18 of the Lakewood Zoning Ordinance, for the properties that are included in RZ-01-006.

SECTION 2. That the City Council of the City of Lakewood approve the attached Development Agreement to be entered into by the City of Lakewood and Continuum Lakewood Development Company LLC, so as to extend vesting of property rights described therein not to exceed 20 years. A copy of said Development Agreement shall be on file in the City Clerk's Office and available for public inspection.

SECTION 3. The Mayor and Clerk of this City are hereby authorized and directed to certify the within and foregoing approval and acceptance. The Clerk of this City is hereby authorized and directed to file with the Clerk and Recorder of Jefferson County, Colorado, together with a certified copy of this ordinance attached thereto, pursuant to the effective date thereof.

SECTION 4. Direct the City Clerk to publish notice in a newspaper of general circulation describing the type and intensity of use approved, the specific parcel or parcels affected and stating that a vested property right has been created.

SECTION 5. This ordinance shall be deemed effective upon the effective date of the zoning ordinance relating to RZ-01-006.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 28th day of January, 2002; published in full in the Jefferson Sentinel on the 31st day of January 2002; set for public hearing on the 11th day of February, 2002 read, finally passed and adopted by the City Council on the 11th day of February, 2002; and signed and approved by the Mayor on the 12th day of February, 2002.
